TCG Ultra offers this website, including the information, products, features, and services available through it, conditioned upon your acceptance of these Terms of Service.

By visiting our website, creating an account, submitting an order, or otherwise using our services, you agree to be bound by these Terms of Service, together with all policies referenced in them, including our:

SECTION 4 – PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, photographs, packaging, quantities, conditions, and other information accurately.

However:

• Product colors may appear differently depending on your screen or device.
• Manufacturers may change packaging, artwork, labeling, or minor product details without notice.
• Promotional images may show multiple sides or views of a single product.
• Packaging may contain minor manufacturer imperfections that do not affect the product’s intended use.
• Release dates and distributor arrival estimates may change.

Any substitution or variation will not materially change the product ordered unless disclosed to and accepted by the customer.

If a material product-description error is discovered, we may contact you for instructions or cancel and refund the affected item.

SECTION 5 – PRODUCT AVAILABILITY

Products may be available in limited quantities and may be offered exclusively online.

Inventory information may occasionally be inaccurate because of simultaneous purchases, inventory-counting errors, damaged inventory, supplier changes, or technical issues.

Adding an item to your cart does not reserve the item or guarantee availability.

We reserve the right to:

• Limit the quantity of any product sold
• Establish per-customer, household, payment-method, address, or account limits
• Discontinue a product
• Cancel orders exceeding published or reasonably applied purchase limits
• Decline orders associated with automated purchasing, fraud, promotion abuse, or unauthorized commercial redistribution

Any quantity limitations will be applied in a manner permitted by applicable law.

SECTION 6 – ORDERS AND ORDER ACCEPTANCE

Submitting an order is an offer to purchase the products listed in the order.

An order-confirmation email acknowledges that we received your order. It does not necessarily mean that the order has been accepted or that every item is available.

We may accept or decline an order after reviewing:

• Inventory availability
• Product limitations
• Payment authorization
• Shipping information
• Fraud indicators
• Pricing or listing errors
• Compliance with these Terms

An order is accepted when we send a shipping confirmation or otherwise expressly confirm acceptance.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the canceled amount.

SECTION 7 – PRICES, PAYMENTS, AND TAXES

Product prices may change without notice. A price change does not affect an order that we have already accepted, except where correction is permitted by applicable law.

Applicable shipping charges, taxes, and other charges will be displayed at checkout when reasonably determinable.

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you represent that:

• You are authorized to use the selected payment method.
• The information submitted is accurate.
• You authorize us and our payment processors to charge the amount displayed at checkout.

We may request additional information to verify an order. An order may be delayed or canceled if requested verification cannot be completed.

Temporary authorizations or pending charges may appear even when an order is later canceled. The timing for releasing an authorization is controlled by the applicable bank or payment provider.

SECTION 8 – PRICING AND LISTING ERRORS

Occasionally, product information may contain typographical errors, incorrect prices, incorrect quantities, inaccurate availability, or other mistakes.

We reserve the right to correct errors and update information.

When an error materially affects an order that has already been submitted, we may:

• Contact you to obtain approval for the corrected terms
• Cancel the affected item or order
• Issue an appropriate refund

We will not charge a higher corrected price without obtaining your agreement.

SECTION 9 – PREORDERS

Products identified as preorders are expected to ship after their anticipated release or arrival date.

Preorder release dates and arrival estimates are not guaranteed and may change because of manufacturer, distributor, transportation, allocation, or other delays outside our reasonable control.

Unless otherwise stated, orders containing both preorder and in-stock products will ship when all items are available.

When a preorder is materially delayed, we may provide you with the choice to:

• Continue waiting for the product
• Cancel the affected item or order and receive an applicable refund

Preorder quantities may be reduced or canceled if a manufacturer or distributor reduces our allocation. If this occurs, we will refund the canceled quantity.

Additional preorder conditions displayed on the product page are incorporated into these Terms.

SECTION 10 – PROMOTIONS AND DISCOUNT CODES

Promotions, coupons, rewards, and discount codes:

• May be limited to particular products, customers, dates, or order values
• May not be combined unless expressly stated
• Have no cash value
• May be changed or discontinued before use
• May be limited to one use per person, household, account, address, or payment method

We may cancel discounts or orders involving suspected promotion abuse, account duplication, automation, unauthorized code distribution, or other attempts to circumvent promotional restrictions.

A promotional change will not affect an order already accepted unless required to correct fraud, an error, or unlawful activity.

SECTION 11 – SHIPPING AND DELIVERY

Order processing, shipping rates, delivery estimates, address requirements, tracking, and package-related procedures are governed by our Shipping Policy.

Shipping and delivery estimates are not guaranteed unless expressly identified as guaranteed.

If we are unable to ship within the promised time, we will provide any notice, cancellation option, consent request, or refund required by applicable law.

Customers are responsible for providing a complete and accurate shipping address. Address changes cannot be guaranteed after an order is submitted.

SECTION 12 – RETURNS, REFUNDS, AND FINAL-SALE PRODUCTS

Returns, refunds, exchanges, cancellations, damaged-item claims, and final-sale restrictions are governed by our Return and Refund Policy.

Certain products are final sale because of tampering, substitution, condition, authenticity, randomized-content, and market-value concerns. These products may include:

• Individual raw or sleeved trading cards
• Professionally graded cards
• Booster packs
• Booster boxes
• Elite Trainer Boxes
• Booster bundles
• Collection boxes
• Tins, decks, blisters, and similar sealed TCG products
• Mystery products
• Products containing randomized contents
• Products clearly identified as final sale or clearance
• Gift cards, except where otherwise required by law

This final-sale restriction does not eliminate any rights that cannot legally be waived and does not prevent a customer from reporting a wrong, materially defective, or shipping-damaged item.

If these Terms conflict with our Return and Refund Policy regarding a return or refund, the more specific Return and Refund Policy will control.

SECTION 13 – MANUFACTURER DEFECTS AND WARRANTIES

Products may be covered by warranties offered by their manufacturers. Manufacturer warranties, when available, are provided and administered according to the manufacturer’s terms.

TCG Ultra does not control manufacturer grading standards, print quality, card centering, packaging processes, collation, pull rates, or the contents of randomized products.

Except for rights or warranties that cannot legally be excluded, TCG Ultra does not provide an additional product warranty beyond any written commitment expressly made by TCG Ultra and any applicable manufacturer warranty.

Nothing in these Terms excludes or limits a warranty, remedy, or consumer right that cannot be excluded or limited under applicable law.

SECTION 14 – RANDOMIZED PRODUCTS

Trading-card and collectible products containing randomized contents are sold without any promise or guarantee regarding:

• Particular cards or characters
• Pull rates
• Rarity distribution
• Monetary value
• Grading potential
• Resale value
• Investment performance
• Completeness of a manufacturer’s production run

Published odds, configurations, or expected contents supplied by a manufacturer are controlled by that manufacturer and may not guarantee the contents of an individual package.

SECTION 15 – RESALE AND MARKET VALUE

Collectible products may increase or decrease in market value.

TCG Ultra does not provide investment, financial, grading, or resale advice and does not guarantee that a product will retain or increase its value.

A later change in market price does not entitle a customer to a price adjustment, cancellation, return, or refund except where expressly provided in our policies or required by law.

SECTION 16 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications, payment methods, shipping services, social-media features, or other services operated by third parties.

Third-party services may be governed by their own terms and privacy policies. We do not control those services and are not responsible for their independent conduct, availability, or policies.

Your use of a third-party service is at your discretion and may require acceptance of separate terms.

SECTION 17 – THIRD-PARTY MARKETPLACES AND LINKS

Our products may also be sold through third-party marketplaces or platforms.

Purchases made through a third-party marketplace may be subject to that marketplace’s terms, payment procedures, return rules, dispute processes, and buyer-protection policies. To the extent a marketplace’s mandatory terms conflict with these Terms for a marketplace transaction, the marketplace’s applicable terms will control that transaction.

Our website may contain links to third-party websites. A link does not necessarily mean that we endorse or control the third party.

We are not responsible for the content, security, availability, or practices of third-party websites.

SECTION 18 – INTELLECTUAL PROPERTY

The website and its content, including text, graphics, logos, store designs, photographs created by TCG Ultra, videos, and original written materials, are owned by or licensed to TCG Ultra and are protected by applicable intellectual-property laws.

Product names, characters, logos, and trademarks belonging to Pokémon, Bandai, Konami, Wizards of the Coast, sports organizations, manufacturers, and other third parties remain the property of their respective owners.

Unless expressly stated, TCG Ultra is an independent retailer and is not affiliated with, endorsed by, or sponsored by any manufacturer, intellectual-property owner, grading company, or marketplace merely because we sell or display its products.

You may not copy, reproduce, distribute, modify, publish, scrape, or commercially exploit website content without permission from TCG Ultra or the applicable rights holder.

SECTION 19 – REVIEWS, COMMENTS, AND USER CONTENT

When you submit a review, comment, photograph, suggestion, or other content, you represent that:

• You have the right to submit it.
• It is accurate to the best of your knowledge.
• It does not infringe another person’s rights.
• It does not contain unlawful, deceptive, threatening, defamatory, obscene, or malicious material.
• It does not contain malware or harmful code.

You grant TCG Ultra a nonexclusive, worldwide, royalty-free license to display, reproduce, format, and use the submitted content in connection with operating and promoting our business.

You retain ownership of your original content.

We may remove content that violates these Terms, applicable law, platform requirements, or reasonable moderation standards.

SECTION 20 – PERSONAL INFORMATION

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.

Payment information may be processed by Shopify, payment processors, financial institutions, fraud-prevention providers, and other service providers necessary to complete a transaction.

SECTION 21 – PROHIBITED USES

To the fullest extent permitted by applicable law, TCG Ultra’s total liability relating to a particular transaction will not exceed the amount paid to TCG Ultra for the product or transaction giving rise to the claim.

These limitations do not apply to:

• Fraud or intentional misconduct by TCG Ultra
• Gross negligence where it cannot legally be limited
• Personal injury or property damage where liability cannot legally be limited
• Obligations expressly accepted by TCG Ultra
• Statutory, warranty, or consumer rights that cannot legally be waived

Some jurisdictions do not permit particular limitations or exclusions. In those jurisdictions, the limitations apply only to the maximum extent legally permitted.

SECTION 24 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold TCG Ultra harmless from third-party claims, liabilities, and reasonable expenses arising directly from:

• Your unlawful use of the website
• Your material violation of these Terms
• Content you submit that infringes another person’s rights
• Fraudulent or intentionally harmful conduct by you

This obligation does not require you to indemnify TCG Ultra for claims caused by TCG Ultra’s own negligence, unlawful conduct, or breach of these Terms.

SECTION 25 – EVENTS OUTSIDE OUR CONTROL

TCG Ultra is not responsible for a delay or failure caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fires, carrier disruptions, labor interruptions, government actions, utility outages, cyberattacks, supply-chain disruptions, manufacturer delays, or platform failures.

This section does not eliminate any obligation to provide notice, cancellation rights, or refunds required by applicable law.

SECTION 26 – TERMINATION

You may stop using the website at any time.

We may suspend or terminate access to the website when we reasonably believe that you have violated these Terms, engaged in fraud or abuse, created a security risk, or used the website unlawfully.

Provisions that logically should continue after termination—including payment obligations, intellectual-property protections, liability limitations, and dispute provisions—will survive termination.

SECTION 27 – SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed where necessary.

The remaining provisions will continue in effect.

SECTION 28 – NO WAIVER

A failure by TCG Ultra to enforce a provision of these Terms on one occasion does not waive our right to enforce it later.

A waiver must be in writing and applies only to the specific circumstance for which it was given.

SECTION 29 – ENTIRE AGREEMENT

These Terms, together with the policies and product-specific terms incorporated by reference, constitute the agreement between you and TCG Ultra regarding use of the website and purchases made through it.

If a product page or promotion contains specific terms that conflict with these general Terms, the more specific terms will control for that product or promotion.

SECTION 30 – GOVERNING LAW AND VENUE

These Terms and transactions conducted through this website are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to Virginia’s conflict-of-law principles.

Nothing in this section deprives a consumer of a protection that cannot legally be waived under the law applicable to that consumer.

To the extent legally permitted, disputes relating to these Terms or website transactions may be brought in the state courts serving Fairfax County, Virginia, or the federal courts serving that jurisdiction.

SECTION 31 – CHANGES TO THESE TERMS

We may revise these Terms periodically.

Updated Terms will be posted on this page with a revised “Last updated” date. Material changes will apply prospectively unless applicable law permits otherwise.

Terms in effect when an order is accepted will generally govern that transaction unless the parties agree otherwise or a change is required by law.
